In this globalised age where the world is progressing rapidly, women in Nepal are forced to tolerate inhumane act and have to loose their lives being alleged as witches. The practices of punishing women in the name of witch are on rise in our society. Every sensible Nepali citizen is concerned in such issues. If we look at the data of WOREC Nepal, 92 cases of violence against women (from 2011 April to Feb) alleging as witches are reported in this year. This raises a serious concern for entire humanity.

This campaign on violence against women alleging as witch is conducted in 75 districts having special programs in 16 districts. The main objective of this program was to draw the attention of concerned authority against such practices, and to protect and promote human rights, raise awareness in the society and change the existing social structure. The campaign was formally started on 11 April 2012( 2068 Chaitra 29). This program was organized in coordination of National Women Human Rights Defender with the close cooperation of Care Nepal, Action Aid Nepal, WOREC Nepal, National Women Rights Forum, Kritika social and cultural transformation and Women Forum for Women.

Recent nationwide increase in cases of rape has been a serious concern. The data from WOREC Nepal during the last three months reports (Baisakh to Asar 2070),149 cases of rape and 14 cases of attempted rape on women[1]. Most of the survivors are dalit, poor, single women or young girls.

The people’s movement of 62/63 aimed for justice, equality and self-dignity of every Nepali. However, the lack of effective laws and impunity clearly show the bitter truth that our country is not heading toward that direction. Lack of access to justice-socially and legally to the survivors has compounded the situation.

Existing law against rape is discriminatory. The existing provisions under the law give a message that raping certain age and group of women is less punishable than other. Similarly, the lengthy and complicated court proceedings add further complication to the process. This situation has fostered culture of impunity and boosted the moral of perpetrator to complacently continue the crime. The condition is unbearable and demands immediate action from every concerned citizen and institutions of the country to come forward and act together to end and transform the situation of violence for creating a sustainable to peace in the country.

Focusing on the situation, in leadership and coordination of National Alliance of Women Human Rights Defenders (NAWHRD) National campaign against rape will be launched on 22nd of November 2013; this campaign will start from International peace day and end on International human right day-December 10th. This campaign thrives to make the linkages of human rights and peace clear and reinforce that without addressing human rights of women who are 51 percent of population, achieving human rights for all and creating sustainable peace is impossible. We appeal all stakeholders, individuals, activists, academics, media and people who believe in human right, social justice and peace to be part of the National campaign.

Objective of the Campaign:

To increase existing level of awareness on sexual violence and create environment for internalization by every citizen of the country to understand that sexual violence is a severe violation of women’s right, which affects women and society physically, mentally and socially and creates difficulty for government to fulfill its due diligence obligations..

To increase access to justice both socially and legally for all survivors of rape.

Demands of the Campaign:

Immediate enactment of comprehensive, effective and aligned with human rights norms and standards new law against Rape ( in present context bring the new law by ordinance)

Establishment of Fast Track Court, and as temporary measure implement the supreme court’s decision on continuous hearing and ensure justice to all survivors of violence within specific period (one year)

Formulation of new victim, gender sensitive investigation manual for investigation of cases of sexual violence with clear inbuilt accountability mechanisms to ensure its proper and effective implementation.

Enact with proper allocation of budget Action as per the state’s commitment on CRC and CEDAW to ensure all the rights of women and girl children affected by rape and sexual exploitation.

Formulation of necessary laws to establish discrimination or stigmatization of rape survivors against rape as a social crime and establishment of necessary legal provisions to punish the perpetrators involved in such crime.

Create proper mechanism to implement NAP 1325 and 1820 effectively and create credible base and structures to vent without any fear of retaliation, stigmatization and re-victimization for survivors of SV during conflict

Timeline of the National Campaign:

The campaign will be started on 22nd September 2013 and end on 10th December 2013

In Nepal as in many parts of Southeast Asia, the tradition of requiring a bride’s family to provide a dowry is illegal but its practice is common. Although the dowry has become a tool of economic exploitation against women and the number of dowry-related murders appears to be on the rise, coercive dowry agreements are currently only a nominally punishable crime in Nepal and most are made with impunity. Nepal has acceded to most major human rights treaties, but many legal provisions and policies are still discriminatory against women. Laws related to dowry are not implemented effectively due to weak governance and the patriarchal mindset. In this context, Nepali women do not have equal rights.
Dowry system is a practice of giving money or property or some kinds of special gifts at the marriage of a daughter by the father to bridegroom or bridegroom’s family. Generally dowry includes cash payment, jewels etc. Dowry is known as ‘Daijo’ in Nepali and ‘Dahej’ in Hindi, Maithali, Vojpuri language. It is a social dangerous evil of Nepal. It is mainly common in Terai Madhesh region. Dowry system has affected our society very badly and seriously. Death of women due to dowry is increasing; many daughters-in-law and wives are physically and mentally tortured due to the lack of dowry. The bridegroom’s side openly demands the dowry before marriage. If the dowry is not much as their demand groom sometimes leaves the marriage. It has been very difficult for the daughters of poor parents to get married.
There are lots of cases of dismiss the marriage if the father of girl did not give a motorbike as asked by the groom’s family. Many of the victims are burnt to death they are doused in kerosene and set light to. In these types of cases the in-laws claim that it was simply an accident. When facts unclean the story changes to suicide and said blame the girl that she can not adjust with new family so that killed herself.
In 21st Century, still “marriage”, is loosing its dignity because of this dowry system. It is high point of time to Raise Voice against Dowry so we have to step up immediately. Keeping this in mind WOREC together with different Human Right Organizations, Human Right Activists had Lunched Anti Dowry Campaign.

National Women’s Social Forum for ” A Federal Democratic Nepal based on Equality

and Social Justice is Possible: We can bring this “

International Women Worker’s Day 2009

Social Forum:

Social forum is an open platform to express the voice of suppressed, voiceless and socially

exploited groups. Groups who have been forced to become underprivileged due to various

[prejudiced practices within socio, economic and political spheres will come together to opined

on their struggle and issues of marginalization and develop concrete and appropriate strategies

to ensure their fundamental human rights are ensured collectively in these forums. This is a

forum that analyses underpinning factors of marginalization, in the present context of Corporate

Globalization, Free market policies and dominant neo-liberal policies. This forum provides a

breaking forum to connect dominant Global issues to the National realities. Collective actions for

Social Justice, Speaking out for Equality are some of the ingrained values of these forums.

The campaign of Social Forum started in Brazil that flowed into Mumbai of India, moving into

Karachi of Pakistan through Burma, Caracas of Venezuela, Nairobi of Kenya, Sri Lanka and

different nations of the world. Nepal will be the next venue also it for the South Asia Social

Forum to be planned near future. Following the main theme/slogan of all the social forums in the

world ‘Another World is Possible’, the women of Nepal are starting the process with the main

slogan- ” A Federal Democratic Nepal based on Equality and Social Justice is possible- We can

bring Changes.”

Social Political Context:

The historical and revolutionary People’s of 2006 paved way for the First Inclusive Constituent

Assembly( CA) Elections in 2008 creating hope for those groups who have been deprived from

their basic fundamental rights by various structures. This was the struggle for Conflict

transformation to a New Nepal and it has been made possible by civil society and progressive

political forces This became possible due to struggle by progressive political forces and civil

society along with contributions for all the groups against autocratic regime.

The struggle and contribution of Women against autocracy and oppression has been historic and

heroic. Women took decisive and active role in various fronts of struggle. At present the process

of institutionalizations of the achievements of Jan Aandolan-2 has been begun through

constitution drafting process. The elected Government has started its function however the

expectations of the people are still far behind. Power structures, values and system of

Governance has not been changed which makes the delivery part even more difficult. Geopolitical

situation of the country is also creating additional complication to achieve the expected

Goal.

Rationale of National Women Social Forum Nepal (NWSF):

Nepal, at this juncture of history is at critical transitional phase. Careful efforts from all

stakeholders can transform Nepal from Feudal Unitarian state to Federal democratic republic,

from exclusive to inclusive and from feudalistic to Equality based. However this is not an easy

task to achieve. Political transformation alone without transforming social relations of production

can’t bring the desired changes. To achieve the desired changes and make people feel the sense

of democracy in their daily life, present Government of Nepal has initiated different programs

focusing on marginalized communities on one hand, and the process of constitution drafting has

been initiated on the other. These achievement gives hope that the Dream of Nepali people can

become reality. However, deep embedded feudal patriarchal values in all spheres of society

including within the structures of progressive political forces and civil society movements can

create difficulty to achieve the change. Beside this, geopolitical situation of Nepal and already

deeply ingrained neo-liberal policies within structures of Governance also needs careful analysis

and concentrated efforts to convert these challenges into opportunities. Nepali women played

decisive role to achieve present political transformation. Their Nurturing role and wisdom has

facilitated progressive leaders to reach to the thousands of people residing in remote areas,

organize them and flourish the movement. Women’s role as peace builders and caretaker of their

families during violent political conflict has played very important role to maintain the social

relations and keep society functioning. Strong position and actions of women within People’s

Liberation Army of Maoist has contributed to establish the party and contribute to establish the

party as one of the biggest party of the country.

In present political phase of Nepal, this contribution of women is seemingly being undermined.

Tendency to forget women’s contribution and marginalize them is being commonly practiced

even by Progressive Political Parties who are leading the country. Political parties are repeatedly

violating their own commitment to include at least 33 percent women in all structures of

Governance. Violence against women is increasing and established culture of impunity is creating

extremely difficult environment for women to access justice. Thousands of women who has been

displaced, abused (physically, mentally, sexually), tortured by structures of power during Violent

political conflict are waiting for justice. Thousands of women who contributed to the people’s war

together with their fellow cadres within People’s Liberation Army are still waiting for reintegration

within National Security System. Women are forced to continue stereotypical role given to them

by society as caregivers. This situation is raising questions on Political parties’ commitment for

social justice. Creating challenge for peace in country, these issues are being undermined with

justification prioritizing issues related with Federalism, distribution of resources, and other which

are considered as hard and pertinent. Women don’t believe on this. From women’s perspective

peace can’t get institutionalized unless values, structures and institutions get transformed

through participatory, empowering, transparent and non-corrupt processes. Nepali politicians

and civil society needs to be reminded about that. However this is not an easy task this

possesses different challenges. Some of them are as follows:

• The challenge of redefining politics

• The challenge of globalization and global governance

• The challenge of gendering civil society

National Women’s Social Forum Nepal is a platform of all women to discuss collectively and find

ways to overcome those challenges. This is also a forum where women can discuss issue

concerning to their life, livelihood, dignity, freedom and identity. In present political context

where 14 committees including a Constitutional Committee, 10 thematic committees and three

procedural committees have been formed and started their work to collect people’s voices and

issues to be included into new constitution. This forum is believed to facilitate to collect women’s

voices and submit to the CA members and CA committees.

In this context, NWSF is a common meeting ground of large number of Nepalese women for

open dialogue as an important mechanism for developing a new vision and a long term strategy

for making just society where the fundamental human rights of people are respected and

guaranteed. The NWSF will raise the local and national social issues with the current global

context and its impact on the national context that will be discussed heavily among the

participants to draw common consensus.

15-16th March, 2011

Initially thought of in Brazil in 2001, where marginalized community took the leadership and make this a venue to express their voices, Social forum has spread to India, Pakistan, Burma, Venezuela, Kenya, Sri Lanka, etc . In Nepal, the first National Women’s Social Forum was held in 2009, followed by the Regional Women’s Social Forum which took place in all the five development regions of the country. The Social Forum has historically been a space to question the global development apparatus as well as the current neoliberal polices and market-oriented policies. In Nepal, the main theme of the Social Forum is “A democratic Nepal based on Social Justice and Equality is Possible – We will build it”.

Overall, the Social Forum demands for democratic principles and transformation of prevalent structures, recognizing the heterogeneity and the inter-linkages of women’s issues in Nepal.
It is aimed at fortifying the voices of the marginalized and oppressed by empowering them to claim their rights. Its main objectives are to create positive pressure to make all the stakeholders accountable to end all kind of violence and discrimination against women.

The event this year took place in the crucial moment of the current political deadlock and the consequent delayed promulgation of the constitution. With only 73 days remaining for the deadline given for the promulgation, the event is meant to provide a ground for discussion and to collect voices for pressurizing the constituent assembly, the government and policy makers for a timely, democratic and gender-sensitive constitution.

Objectives

The participants have the opportunity to discuss and to question the development apparatus of the country and the shortcomings of the existent neo-liberal policies from a gender sensitive standpoint.
The forum allows for inter-movements dialogues. Heterogeneous movements get to have a better understanding of each other and share their different experiences.
It also provides a platform for different generations of feminists to come together to confront each other’s views and integrate their different perspectives.
Outcome
Over 1000 people from all over Nepal gathered on the 15th of March for the rally and the following events. The rally started at Bhadrakali and went around Tundikhel to converge in Bhirukuti Mandap where the following events were to be held. There was representation from marginalized communities such as Dalits, LGBTIs, differently able, women from the Muslim community, indigenous communities, Madhesis, women living with HIV/Aids, different ethnic groups alongside women from the housing rights movement and from the land rights movement. Migrant workers and women working in informal sector were also a part of the activities.

About 22 workshops took place, covering topics such as: Social and Cultural Rights, Right to food, Human Trafficking, Land Rights, Sexual Rights, Women in Politics and in the Decision Making Process, Dalit Women’s Issues, the History and the Future of the Feminist Movement in Nepal, Women’s Experience and Contribution to the Peace Building Process, Migrant Workers Eights, Sexual Violence and Access to Justice for the Victims, Protection of Women Human Rights Defenders.

The thematic workshops were aimed at finding common ground to make women’s voice clearer and stronger. Based on the common standpoints elaborated during the workshops by the different movements, a Declaration has been drafted and it is to be disseminated.

Many organizations disseminated information through IEC stalls. A Cycle City 2020 campaign working to promote Kathmandu as cycle friendly city also had a stall through which they promoted their various go green campaigns. In addition, a cultural programme presented by groups representing different part of the country was held, including performances by the Kritika campaign, who also released their new album, “Beg 3” on the same occasion.

Also, a photo exhibition on the struggle of Nepali women for democracy has been displayed in different locations of the venue. Thanks to the collaboration of the Docskool two movies engaging with the topic of discrimination directed by Mr. Shyam Benegal have been showed at the end of the daily programme: “Ankur”(March 15), and “Mandi” (March 16).

A plenary workshop was conducted at the conclusion of the event and brought forth the conclusions of the various thematic workshops and highlighted on the main points to be included in the Declaration.
