Terms of Reference

Position title: Legal-Aid Consultant/-1 (only Women)

  1. Background:

Women’s Rehabilitation Centre (WOREC) is a non-governmental organization working for the protection and promotion of human rights. Established in 1991, WOREC is one of the leading national organizations that works to prevent violence against women, its causes and consequences, and to ensure economic, social and cultural well-being of women as well as other marginalized groups by promoting their access to rights and social justice.

WOREC has been providing legal aid support and legal awareness under it’s GBV response and prevention programs in various districts. WOREC is now implementing Hamro Sahas: Feminist Movement Building for Social Norm Change project in Dang and Kapilvastu under it’s Human Rights and Social Justice Theme. To provide legal aid support to women and young girl survivors. Likewise, WOREC also provides legal awareness support to women, young girl and LGBTIQ+ survivors from indigenous minority, marginalized community and religious minority seeking justice against GBV, intimate partner violence, forced marriage, child marriage, and dowry-related violence. Thus, a legal consultant will be hired to provide the services in both districts.

  • Consultant’s scope of work:

The Legal Consultant will provide technical and operational support to strengthen access to justice for women, girls, and marginalized communities under the Hamro Sahas Program. The consultant will be based in Kathmandu and oversee legal interventions in Kapilvastu and Dang.

 Key responsibilities include:

  1. Legal Analysis and Research:
  2. Conduct comprehensive analysis of existing laws, policies, and legal frameworks related to gender-based violence (GBV), child marriage, domestic violence, cybercrime, and women’s and girls’ rights within the criminal justice system.
  3. Identify gaps, challenges, and opportunities for legal reforms to enhance protection and justice for survivors.
  • Legal Aid and Counseling: Provide legal counseling and support to GBV survivors, women, adolescent girls, and LGBTIQ+ individuals from indigenous, minority, and marginalized communities.
  • Support documentation of cases and provide representation in court or coordination with legal professionals where required.
  1. Documentation and Reporting:
  2. Prepare detailed legal analysis documents, advocacy briefs, position papers, and case studies.
  3. Compile data-driven reports using WOREC and Anweshi database systems to support policy advocacy and programmatic decision-making.
  4. Ensure proper case documentation and maintenance of confidentiality and ethical standards.
  5. Evidence-Based Advocacy and Policy Support:
  6. Develop advocacy documents and recommendations for policy reforms, using evidence from field-level reporting and research.
  7. Support initiatives aimed at influencing national and local stakeholders, including government bodies, judiciary, and civil society networks.
  8. Technical Support to Field Offices:
  9. Provide guidance and oversight to program teams in Kapilvastu and Dang to ensure quality legal case management, documentation, and reporting.
  10. Strengthen referral mechanisms and coordination with other GBV service providers.
  11. Capacity Building and Knowledge Sharing:
  12. Contribute to the development of training materials and facilitate legal awareness sessions for staff, stakeholders, and community members.
  13. Support knowledge management by documenting best practices, lessons learned, and case studies.
  14. Ethical Compliance:
  15. Maintain survivor-centered, ethical, and feminist approaches in all interventions.
  16. Ensure strict confidentiality and adherence to WOREC’s values and organization
  • Required expertise:
  • Academic qualification of BALLB/LLB/LLM
  • Person having lawyer license
  • Experience of working as lawyers at least for 3 years
  • Familiarity with right-based approaches and feminist views with
  • Duration of work:

The duration of work be from 15 April, 2026 to December 2026 and the consultant should provide the time sheet, report and workplan on monthly basis. The consultant will work closely with district coordinator, program coordinator, and Program Manager of WOREC.

  • Payment schedule:

Payment to the consultant will be done after the completion of the training and providing reports.

Note: 15% tax will be deducted from the amount after completion of service and submission of appropriate invoices.

  • Entire Contract

This contract is the final, exclusive and complete expression of the consultant agreement related to this service, and it supersedes all task, oral or written, and all other representations, statements, negotiations and undertakings relating to the service unless expressly incorporated herein.  No modification of any term, provision or condition in this contract shall be effective unless it shall be in writing and signed by the consultant. However, as per the need both parties should be agreed to provide the services for further days.

  • Relationship of the Parties

In performing the services, the consultant shall act as an independent and shall not be deemed to be an employee or agent of WOREC.  The consultant shall be solely responsible for and shall be liable for, indemnify, defend and hold WOREC harmless against all wages, fees, contributions, charges and taxes required by legislation. All appropriate deductions are made in respect of income tax and other contributions.

WOREC shall not be liable for providing any benefits of any kind except as provision of payment mentioned above in sub heading 6 to the consultant.

This contract shall not be deemed to create any kind of partnership, joint venture, agency or franchise agreement with the Consultant.

  • Assignments and Sub-Contracting

The consultant shall not assign this contract its right or obligations under this MOU, in whole or in part. Nor enter into any sub-contracting to perform any portion of this MOU, without the written consent of the organization.

The consultant shall not sublet the whole or part of their obligations without the prior written consent of WOREC, which consent, if given, will not relieve the consultant from any liability or obligation under this contract.  The  consultant shall be responsible for the acts and omissions of any sub-contractor as if they were the acts or omissions of the consultant.

  • Termination

Without prejudice to the rights of the other consultant under this contract, consultant shall have the right to terminate this contract for any reason at any time in writing to the other Consultant. If consultant exercises its rights to terminate this contract, the consultant shall immediately cease all services and shall return to WOREC any resources loaned by WOREC.  All material prepared in advance shall be given to WOREC and may be invoiced for under the terms of this agreement. WOREC maintains strict zero tolerance policy. In case the consultant does not follow the code of conduct of PSEA or is found to be involved in any kinds of fraud, discrimination, or violence based on caste, gender, gender identity, sexual orientation class, ethnicity, indigeneity, language, race or geography the contract shall be subject to immediate termination.

  1. Confidentiality

The consultant agrees not to discuss its performance of services or any confidential information to which the consultant may have access, as a result of this MOU with any third party without obtaining written consent from the organization.

  • Risks and Challenges

It is important that the hired consultant has taken all reasonable measures to mitigate any potential risk to the delivery of the required outputs for this consultancy.

  • Data Protection

The Consultant shall not disclose or allow access to any other personal data provided by WOREC or acquired by consultant during the course of performing the service other than to a person employed by the consultant or an approved sub-contractor with the prior consent of WOREC.

Any disclosure of or access to personal data allowed under above clause shall be made in confidence and shall extend only so far as that which is specifically necessary for the purpose of this contract.

If the Consultant fails to comply with any provision of this condition, then WOREC may summarily determine the contract by notice in writing provided always that such determination shall not prejudice or affect any right of action or remedy which shall have accrued or shall accrue thereafter to WOREC.

  • Law

This contract and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with Nepalese law and the parties irrevocably submit to the exclusive jurisdiction of the courts of Nepal.

  • Entire Contract
